1986V923P8 3'735103 E OC T 2 7 1936 UTILITY EASEMENT Iva OCT 20 P{ I' 36 (Specific Property) STATE OF TEXAS ) �' - / KNOW ALL MEN BY THESE PRESENTS: COUNTY OF BRAZOS ) That, DAVID LEWIS and wife, KELLI LEWIS, GRANTORS, of the County of Brazos, State of Texas, for and in consideration of the payment of TEN and NO/100 DOLLARS, and other good and valuable consideration, in hand paid to GRANTORS by the CITY OF COLLEGE STATION, TEXAS, the receipt of which is hereby acknowledged, have GRANTED, SOLD and CONVEYED and by these presents do GRANT, SELL , and CONVEY unto the said CITY OF COLLEGE STATION, a Texas Municipal Corporation, certain rights and interests in the nature of a perpetual EASEMENT on and through the following described property: Being a ten foot wide strip of land in the Morgan Rector League, Abstract No. 46 , Brazos County, Texas, and being a portion of that same 31 . 80 acre tract conveyed to Lewis J. Kirkpatrick, et ux, as described by deed recorded in VOLUME 290, PAGE 362 , of the Deed Records of Brazos County, Texas. Provided , however, that this conveyance shall grantrihts herein specified only as to that portion of theabovehdescribed property more particularly described by course, width, and centerline on the attached Exhibit "A" , known as the "Easement Area" , and any additional area outside the easement area neces- sary to install and attach equipment, guy wires, and anchors necessary and incident to the uses of the Easement Area. To erect, construct, install , and thereafter use, operate, inspect, repair, maintain, reconstruct, modify, and remove the following: Electric lines, poles, guy wires and anchors; upon, over, and across said property as herein described and any ways, streets, roads, or alleys abutting same; and to cut, trim and control the growth of trees and other vegetation on and in the easement area or on adjoining property of GRANTORS, which might interfere with or threaten the operation and maintenance of any public utility equipment, accessories, or operations. It is understood and agreed that any and all equipment and facilities placed upon said property shall remain the property of GRANTEE. GRANTORS expressly subordinate all rights of surface use incident to the mineral estate to the above described uses of said surface by GRANTEE, and agrees to sublender' s subordinations on behalf of GRANTEE upon request. Kirkpatrick, et ux, as described by deed recorded in VOLUME 290, PAGE 362, of the Deed Records of Brazos County, Texas, said strip of land being five feet on either side of the following described centerline: COMMENCING at a 1/2" iron rod found marking the north corner of Brentwood, Section Five as shown by plat recorded in VOLUME 389, PAGE 175, of the Deed Records of Brazos County, Texas, and lying in the southwest right- of-way line of Dartmouth Drive. THENCE N 23° 33' 48".'W for a distance of 192.54 feet with said right-of- way line to a 1/2" iron rod found for beginning of a curve to the right. THENCE in a northwesterly direction for a distance of 90.36 feet along the arc of said curve, (Curve Data: central angle = 04° 23' 15", radius = 1180.00 feet, tangent = 45.20 feet, the chord bears N 21° 22' 18" W for a distance of 90.34 feet) to the PLACE OF BEGINNING of this easement.
