(hereinafter referred to as "Tenneco") , tor and in consideration of the sum of One ($1.00) Dollar, cash to it in hand-paid by the City of College Station, Texas, and other valuable considerations, receipt of which is acknowledged, do hereby give and grant to the City of College Station, Texas, the right to construct, reconstruct, and maintain a sanitary sewer upon and across the following described property: Being a strip of land 20 feet wide for a Sanitary Sewer Line ease- ment situated in the Richard Carter League, Abstract 8, Brazos County, Texas, and being a part of that 50 .57 acre tract of land conveyed to Tenneco as recorded in Volume 302 , Page 274, Brazos County Deed Records, shown as Line "A" on the attached plat. The centerline of said 20-foot easement being more fully described as follows: BEGINNING at a point in the apparent westerly right-of-way line of Tarrow Street and the easterly property line of said Tenneco 50 . 57 acre tract of land, said point also being southerly 72 . 50 feet more or less along the westerly right-of-way line of Tarrow Street from the northerly corner of said Tenneco 50 . 57 acre tract of land; .Thence S 59° 30 ' W 199 .68 feet more or less to an angle \oint, said point also being southeasterly 20 feet from the northwest property line of said Tenneco tract; Thence S 46° 34 ' W 1596. 32 feet 20 feet southeast of and parallel to the northwest property line of said Tenneco tract to an angle point; Thence S 29° 47' E 184 .00 feet to an angle point; s Thence S 13° 00 ' 30" E 293 . 00 feet to an angle point; Thence S 26° 36 ' 30" E 100 .00 feet to an angle point; Thence S 01° 19 ' E 283 . 00 feet to an angle point; Thence S 14° 08' 30" E 124 .47 feet to an angle point; Thence S 33" 00 ' 30" W 213. 30 feet to an angle point; V013=Pcige-1.Q -1102 Thence S 47° 28 ' W 121. 03 feet more or less to a point in a fence marking the southwesterly property line of said Tenneco 50 .57 acre tract of land, said point also being northwesterly 612 feet more or less from the northerly right-of-way line of University Drive and the end of this 20-foot easement. TO HAVE AND TO HOLD the same to the City of College Station, Texas, and its successors, together with the right and privilege at any and all times to enter said strip of land, or any part thereof, for the purpose of constructing, reconstructing, and maintaining the said sewer line facility on the condition that the City of College Station, Texas, work in connection with the construction, reconstruction, and repairing of said sewer line facility, re- store said property to the condition in which same was found be- fore such work was undertaken, and that in the use of said rights and privileges herein granted, the said City of College Station, Texas, and its successors will not create a nuisance or do any act that will be detrimental to said property, nor the adjacent property of grantor. An additional easement for construction purposes is granted for a period of one (1) year from the date hereon, said construction easement being a 100-foot wide strip of land and the centerline of said construction easement following the centerline of said 20-foot sewer line easement. ,L)/ / If the right-of-way easement is not used for the purposes speci- fied for a period of one (1) year, said right-of-way easement shall automatically revert to the Grantor, its successors, and assigns. The City of College Station, Texas, its agents and employees, assigns and successors, shall, as soon as practicable after con- struction of said sewer and all subsequent alterations and repairs thereto, restore all property of Grantor to its former condition, this covenant to run with the easement. This easement is granted on the condition that no assessment to pay any of the cost of constructing said sewer shall be made against Grantor, its heirs, successors, or assigns, and no cost of any kind shall accrue to the Grantor, its successors, or assigns, for tap fees or connection fees to said sanitary sewer, but that any connection and/or taps shall be made at new or existing manholes only.
