Miller of the County of Brazos , State of Texas , for and in consid- eration of the sum of one ($i. 00) dollar to me cash in hand paid by the City of College Station, Texas, a municipal corporation in Brazos County, Texas, duly incorporated under the general laws of the State of Texas, the receipt of which is hereby acknowledged, have granted, sold and conveyed, and by these presents to grant, sell and convey unto the said City of College Station, Texas, certain rights and Interests in the form of an EASEMENT on and through the-following described property. This instrument, grants the City a ten foot (10' ) wide easement the center of which is described as follows: Beginning at point in the northeast right-of-way line of State Highway 6, said point being located approximately N37°141 approximately 329 feet from the most southerly corner of the property. Thence N53°E approximately 1580 feet along and adjacent to the easterly bank of Bee Creek to an angle point. Thence continuing approximately 200 feet to the point of exit in the southeast property line, said point being located approximately 545°14 approximately 3 feet from the most easterly corner of the property, as per attached description„ and out of a 2.5 acre tract conveyed to C.I. Miller 9-11-39 & 3-5-45 Vols.115 Page 431 and 118 Page 613 of the Deed records, Brazos County, Texas. To have and to hold the rights and interests herein before described unto the said City of College Station, Texas, and its successors and assigns forever and I do hereby bind myself, my heirs, executors and administrators, to warrant and forever defend, all and singular these rights and Interests unto the said City of College Station, Texas, and its successors and assigns, against every person whomsoever lawfully claiming, or to claim the same, or any part thereof.
